1. What this is
Stemply is a hosted web service that lets a business run a loyalty programme with digital cards in Apple Wallet and Google Wallet. These terms apply between the seller named above and the business using the service (“you”).
The service is sold to businesses, not to consumers.
2. Account
You are responsible for the security of your sign-in details and for what your staff do with the access you give them. Tell us promptly if you believe an account has been compromised.
3. Subscription and payment
Access is sold as a monthly subscription at USD 25 (Standard) or USD 50 (Pro) per month per location, unless agreed otherwise in writing. The subscription renews automatically each month until cancelled.
Payments are processed by Creem, which acts as merchant of record. Creem collects payment, applies any tax due and issues the invoice for your purchase.
4. Cancellation
You can cancel at any time from the billing section of your account. Access continues to the end of the period you have already paid for. See our refund policy for when money is returned.
5. Your data and your customers' data
Business data you enter — your programme settings, your customers and their visits — belongs to you. We process it on your instructions in order to run the service. See the privacy policy.
You are responsible for having a lawful basis to enter your customers' personal data and for telling them how their data is used.
6. Availability
We aim to keep the service available at all times but do not guarantee uninterrupted operation. Maintenance, third-party outages and problems at Apple or Google can affect it. No specific uptime level is promised with this plan.
7. Acceptable use
Do not use the service to send unsolicited messages, to store data you have no right to store, or to attempt to break its security or access other businesses' data.
8. Suspension and termination
We may suspend or close an account for non-payment, for a breach of these terms, or where required by law. Where the reason allows it, we will contact you first and give you a chance to put it right. You may export your data before closure; ask us and we will provide it.
9. Liability
To the extent permitted by law, our total liability for any claim connected with the service is limited to the amount you paid in the twelve months before the claim arose. We are not liable for lost profit or lost business.
10. Changes
We may change these terms or the price. We will give at least 30 days' notice by email before a change takes effect for you, and you may cancel before it does.
11. Law
These terms are governed by the law of Ukraine. Nothing here removes rights you have under mandatory law in your own country.
